More re the Transnational Century
Some thoughts in English regarding my preference topic of the upcoming transnational century. This is not related to the Clinton quote I just rebloged but to the post in German some weeks ago. I started while I pursue my Msters Degree (LL.M.) at Chicago-Kent College of Law thinking how the law will change because of the developments in the world
I wrote my Master’s thesis about the question whether there is still a justification for the principle of territoriality in international copyright law. This topic relates to my interest in how the circumstances of the 21st century impact the development of the law.
Normally, the situations governed by sovereign state law exist within a defined space and time. But the traditional circumstances, which are the basis of this territorial lawmaking, have changed and continue to change every day.
The art of communicating -particularly through the internet - changes the space we live in. The communication cuts across territorial borders. This is the biggest change of the space we live in. Therefore the law must be adapted to this new space.
I am interested in developing and creating law, which considers these circumstances and is of real use for the people the should serve. In my thesis I will establish an argumentative basis for this non-territorial copyright law. Additionally I am creating a web-based tool to allow a collaborative elaboration of a universal “common core” of copyright law.
The theoretical basis and the elaboration for a universal copyright law should begin the establishment of a universal body of law for the world society, which is growing with the development of the internet technologies.
